These Terms of Use govern your use of AkinaNight, an iOS application provided by Han-Yu Chen.

Purpose and safe use

AkinaNight is an entertainment and interactive experience that simulates a cup of water responding to device movement. It is not navigation software, a driving-safety system, professional vehicle analysis, or a measure of safe driving.

Do not operate the app while driving. Secure your device before starting your trip and always follow applicable traffic laws. Do not use AkinaNight to encourage speeding, racing, unsafe driving, or any dangerous behavior. The simulation must not be used to make driving-safety decisions.

In-App Purchases

AkinaNight may offer In-App Purchases. Transactions, refunds, and billing are handled by Apple and subject to Apple App Store terms and policies. We do not receive or store payment-card information.

Intellectual property

AkinaNight and its content, software, design, and related intellectual property are owned by Han-Yu Chen or applicable licensors and are protected by law. You may use the app only for its intended personal, lawful purpose.

Disclaimer

AkinaNight is provided on an “as is” and “as available” basis to the extent permitted by applicable law. We do not warrant that it will be uninterrupted, error-free, or suitable for a particular purpose. Nothing in these Terms excludes rights that cannot legally be excluded.

Limitation of liability

To the extent permitted by applicable law, Han-Yu Chen will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of AkinaNight. This limitation does not exclude liability that cannot be limited under applicable law.

Changes and contact
